TERMS AND CONDITIONS

LOOPA provides services through its technological platform that allow its clients to view different trends on different social networks regarding certain products and services. The Services provided are carried out through the website and other accesses that are sent directly to the clients and are subject to the following terms and conditions, which will govern our contractual relationship.

Therefore, at the moment in which you have accepted the service proposal and at the moment in which you have used any of the services described below, you are accepting and therefore are bound by the following terms and conditions (hereinafter "Terms and Conditions").

LOOPA reserves the right to change or modify the terms and conditions, policies or references or the price at any time. In the event that this happens, we will notify you by email at the address you have registered with us or by means of notifications on our website or application. However, any prepaid plan or package will remain in effect until terminated. If we have not specified anything in the communication we have sent you, any change or modification will be executed upon updating on the website or application and the continued use of the services; such fact constitutes express acceptance of the changes and therefore you will be bound by them.

If you do not agree with the changes and modifications, you may stop using the services and cancel your account, in which case you may use any prepaid balance you have in your account.

GENERAL CONDITIONS ON THE USE OF LOOPA

1. To access and use our Services, you must accept our service proposal and make the payment detailed therein.
2. You must be over 18 years old.
3. You declare that the services you are receiving from LOOPA are for lawful commercial and business purposes only, and that you are the party responsible for the use and purpose of the information provided by LOOPA.
4. Accept that the email address you registered when creating an account at LOOPA or the one you have updated is the primary form of communication; therefore, you will receive our notifications or communications.
5. Any violation or breach of one or more of the terms described herein may, at our sole discretion, result in the revocation of access to your account and the termination of the Services we provide to you, without the right to any refund.

GENERAL CONDITIONS

1. The moment you accept the service proposal and the scope of the service is detailed based on the contracted plan, our contractual relationship begins. Based on this, if necessary, an action map and delivery times will be established, and once they have been met, you will have access to the generated display screen. 
2. You will use our services only for legal and authorized commercial activities in Ecuador, therefore you will be responsible for compliance with all legal, administrative, regulatory and other obligations that may be applicable. You may not reproduce, duplicate, copy, sublicense or explore LOOPA Services in any way, without our consent.
3. We reserve the right to refuse, modify or terminate the Services for any reason, including without notice.
4. You expressly declare that you are aware of and accept that LOOPA will not be liable for any damage or loss arising from the use or inability to use the services, including loss of data.
5. The use of our Services is at your own risk, therefore the services provided are "as is" and on a "best effort" basis without any warranty regarding them.

THIRD PARTY LIABILITY

You acknowledge and agree that LOOPA is fed with information through connections with various third-party platforms, and therefore we are not responsible for any updates or disruptions to its services for various reasons.

INTELLECTUAL PROPERTY AND CONTENT

You declare that you are aware that all intellectual property rights, industrial property rights or any other rights, including the technology within the program, visualization and content, structure, characteristics, codes, work methods, information systems, development tools, know-how, methodologies, processes, technologies or algorithms belong to LOOPA. Therefore, you may not copy, modify, alter, reproduce, adapt or translate in any way.

Additionally, you may not use or do anything that has not been expressly authorized. In particular, you may NOT transform, reproduce, disseminate, exploit, distribute, transmit by any means, its technology, its services and/or its components.

APPLICABLE LAW AND JURISDICTION

APPLICABLE LAW AND These Terms and Conditions of Use, as well as our relationship, shall be governed by and construed in accordance with the laws of the Republic of Ecuador. Any dispute or difference arising from, relating to, or in connection with this contract shall be resolved by an arbitration tribunal of the Arbitration and Mediation Center of the Chamber of Commerce of Quito, which shall be subject to the provisions of the Arbitration and Mediation Law and the Center's Regulations.
